The problem with patents is that as an inventor you can't know if something is "patent-free", only that _you_ didn't claim a patent on the whole or any part of it. That doesn't mean that there isn't some patent by somebody else that you're already infringing with your invention.

There have been some wild events around media codecs (MP3, MPEG4, ...) based on this nasty property of the patent system.
