@kims Justice Scalia was not always correct in his decision-making (his was often a feisty dissension), but he never ruled from anything other than a deep respect for the Constitution and the rule of law. He would be appalled at the suggestion that anyone here did not merit due process.

@kims Due process is to establish that the deportee is, in fact, an "invader"; otherwise you can accidentally or deliberately deport literally anyone, including citizens. Which has already happened.
Maybe not citizens, yet, and maybe not deliberately, yet. But at least two people have been mistakenly deported to a Salvadoran concentration camp from which they will probably never return. And the administration admits this, yet won't even try to bring them back despite a court order to do so.

@kims Reno v. Flores (1993) 507 U.S. 292, 306, if anyone cares. It's worth noting that Scalia wrote this by way of introducing a holding that due process is satisfied by slapping a form in front of an immigrant juvenile with a check box where he can request a hearing before an immigration judge. If the kid doesn't check it, perhaps as a result of not being very good at reading English and not having a lawyer, there you go; he had the opportunity for a hearing and he waived it so it's "you won't have a name when you ride the big airplane" for him. Scalia was very, very far from being a friend to immigrants. But true enough, he did say that the government has to do SOMETHING that the Supremes can wave their magic judicial wands over and convert to due process.

@kims Set aside the awful, awful inhumane view of this scumbag but to cry about the cost of trials seems to be quite hypocritical giving the fact that nobody in the GOP cares about how much deported people without trial cost. $6 Million to El Salvador per year, $40 Million for those incarcerated in Guantanamo. It seems that fair judicial trials are cheaper. And constitutional.
